[MassHistPres] LHC outstanding non-compliance issue

In Boston, an applicant is required to remedy an outstanding violation
prior to receiving a Certificate of Appropriateness for a new
application. This is policy based on precedent which allows the
Commission some leverage, especially in situations where the district
commission and the city would not necessarily pursue court action to
remedy a particular violation.

Does anyone have a bylaw or Rules and Regs or know of case law which
would speak to the question of whether a commission can decline to
decide on an application for an LHD certificate as long as there is an
outstanding non-compliance issue?
