In Shutesbury, we have passed a zoning bylaw which prohibits the mining
of rock walls (which are often shipped out of town for sale elsewhere).
I'll paste the language below:
3.2-5 The commercial removal of stones from a stone wall, old field
pile, or pre-existing cellar hole from any parcel for the purpose of
transporting the stones out of Shutesbury for sale elsewhere.

Does anyone know whether or not stone walls are considered
archaeological resources when it comes to our MGL laws, Chapter 9,
sections 26 and 27(see below for contents)? I'm guessing they are
defined as remains, but this is not clearly stated. Besides at sites
such as Minuteman NHP, have stone walls been actively preserved as a
result of our state, or even national, laws in Massachusetts? Is this
an area in which more education needs to take place?
FYI: This year, a group of Framingham residents successfully encouraged
Rep. Richardson to file a bill strengthening the penalties for those who
willfully destroy or steal stone walls from private property. As it
stands now, a whopping $10 fine is the maximum for this Crime Against
Property (see Chapter 266: Section 105)! Though the bill wasn't voted
upon this session, we have hope that it will be re-filed in the next
legislative session. We are also working at the local level, getting
the police involved and aware, and trying to educate town residents
about the importance of preserving stone walls on private property. Like
any issue, it's complicated, but we press on.
