[MassHistPres] Minutes becoming public

There is a national trust publication called Procedural Due Process  in 
Plain English:  A Guide for Preservation Commissions by Bradford J.  White and 
Paul W. Edmondson (not dated, but not new.)  We have found this  booklet 
very useful.  Our town counsel gave a 2 hour presentation (with  questions 
galore) to anyone who wanted to attend.  As a result of both of  these, it is 
clear that commissions must be very careful in any type of  communication, on 
any computer, on any email accounts,  etc. outside the  public meeting.  
Most everything is subject to scrutiny in a court  case. As I understand it, 
being a volunteer commission makes no difference  as to requirements.

I  believe if it is between 2 or more members, and it might be 3, then it 
is  considered a public hearing and must be open to all..

based on the  recent controversy in Boston regarding deleted emails. I 
believe that any  correspondence pertinent to the functioning of the board would 
be a matter  of public record. As well as any conversations between members 
of a board or  the public regarding pending matters or the general 
functioning of the  board. I don't think that anybody wants to have to explain to a 
judge why  their board violated open meeting laws and shouldn't have a 
decision  overturned because of it.
