I have just participated in a press conference with the Federally  
Recognized Wampanoag Tribe of Gay Head (Aquinnah).  The Tribe's  representative said 
they are "disappointed and disheartened" by the Cape  Wind ROD.  And, at 
this time they are exploring "specific  rights and legal recourse including 
injunctive relief".  They  expressed intent to file suit.  The Tribe is on the 
record  stating they are not for sale. The Aquinnah Tribe  has already 
refused "mitigation" of approximately $1 million dollars from  Cape Wind.  Secret
ary Salazar mentioned mitigation money is available  today.  The Tribes 
reaffirmed in this context that they are, "Not  for sale". United States South 
and Eastern Tribes (USET), comprised of 25  Federally Recognized Tribes, is 
aligned with the Aquinnah and the Mashpee  Wampanoag in opposition to Cape 
Wind.  
 
An outstanding issue that prevents Cape Wind from moving forward to  
construction is the current FAA DETERMINATION OF PRESUMED HAZARD.  The  project is 
confirmed by the FAA to cause radar interference.  Mitigation is  being 
explored by FAA and the developer, while no remedy has been identified  that 
will prevent clutter and shadowing of radar screens caused by wind  turbines.  
The developer has not committed to funding mitigation that FAA  indicates 
could rise to approximately $12 million dollars without guarantee of  
efficacy.  
 
The U.S. Coast Guard has not identified mitigation regarding navigational  
radar interference caused by wind turbines. The Massachusetts Fishermen's  
Partnership President Edward Barrett stated, "We are outraged and extremely  
disappointed that years of conservation and sacrifice by recreational,  
charter and commercial fishermen are now being put at risk. The loss  to mobile 
gear fishermen alone by Cape Wind siting in Nantucket Sound  will cause our 
loss of $13 million by collaborative  study with University of R.I."  The 
U.S. Passenger Vessel  Association PVA that represents ferry operators 
transporting approximately  3 million annual passengers stated that Cape Wind poses 
a serious hazard  to ferry operators and their passengers. 
 
There are ten parties currently that have announced their intent to  sue.  
This number is expected to increase.
