[MassHistPres] demo delay loopholes

Does anyone have experience with an owner razing a building which falls
under DDB qualifications before the LHC had knowledge of the demolition and
was able to begin the delay process?  Mendon's DDB says that all demolition
permits must be seen by the LHC as well as the local building inspector.  In
this case, there was no permit application filled out. (A permit was given
to demolish two houses and a garage set on adjacent lots in May of 2009
before our DDB was passed.)  It's unclear whether this would be just a
building department issue or whether our HC can invoke its noncompliance
clause which states that the owner can be fined $300/day for two years or
until the building is faithfully restored.  Thank you for any input.
