Lots of issues here:

Paint mural on the wall itself, on canvas to be hung as wallpaper, etc.

We had a large, custom mural done on canvas by Lance Walker of Dennis.  This
was for the Osterville Village Library.  Lance has experience working on
large scale projects which is important in selecting a muralist.  He is an

As many of you know, May is National Historic Preservation Month. To
celebrate and to promote Boston's history, architecture, archaeology and
historic neighborhoods the Boston Landmarks Commission, on behalf of Mayor
Martin J. Walsh and the City of Boston, will again produce a calendar of
local events taking place during the month.

The aim of the Preservation Month calendar is to promote the extraordinary
work that many Boston organizations have undertaken to preserve the city's
history and architecture, and to expose a wider, more diverse audience to
historic preservation and history-related activities taking place in Boston.
The theme of the 2014 city celebration is "Buildings and Grounds."

Secretary Galvin Announces 36th Annual Preservation Awards Program

            William F. Galvin, Secretary of the Commonwealth and Chairman of
the Massachusetts Historical Commission (MHC), is pleased to announce that
the MHC is accepting nominations for the 36th Annual Preservation Awards
Program.

            Administered by the Massachusetts Historical Commission (MHC),
the Preservation Awards Program recognizes preservation projects and
individuals that have displayed an outstanding commitment to historic
preservation in Massachusetts. Projects completed in the years 2010, 2011,
2012, and 2013 are eligible for consideration. The MHC encourages local
historical commissions and societies, preservation professionals, and
individuals to nominate outstanding preservation projects for this honor.
Nominations must be received at the MHC's office in the State Archives
Building by 5:00pm on Friday, February 14, 2014.


            "The MHC's Preservation Awards Program highlights the important
contributions of individuals and organizations to the preservation of
historic resources in Massachusetts," Secretary Galvin said. "This is an
excellent opportunity to recognize a significant historic preservation
accomplishment in your community. I encourage everyone to nominate exemplary
projects or outstanding individuals that have demonstrated an outstanding
commitment to preservation."

The MHC accepts nominations in the following categories:
*         Adaptive Reuse
*         Archaeology
*         Education and Outreach
*         Individual Lifetime Achievement (20 or more years of exemplary
service to historic preservation in Massachusetts)
*         Landscape Preservation
*         Local Preservationist
*         Rehabilitation and Restoration
*         Stewardship

Folks I'm curious how additions are handled under demolition delay bylaws in
other communities.  Further if a demolition delay bylaw does provide
specific jurisdiction over additions does it give the Historical Commission
jurisdiction over the proposed design of the addition.  If not, how is the
jurisdiction restricted. 

 

In Chatham, additions are exempted in the definition of demolition.
However, in the past applications for building permits for additions to
structures more than 75 years old or in the historic district have been
referred to the  Historical Commission for approval prior to issuance of the
building permit on the basis that such additions involve the removal of
exterior walls or roofs and thus the potential removal of historical
material. 

 

This is now being questioned by some of the local builders and attorneys who
are taking the position that additions are exempt from such review.
As a result, the Historical Commission, with the support and assistance of
the Community Development Department and a local attorney, was proposing an
amendment to the bylaw for the purpose of clarifying that additions are
subject to CHC jurisdiction.  Of concern to the Board of Selectmen is if a
proposed amendment was clarifying or expanding the scope of the demolition
delay bylaw and whether the intended clarification was actually endowing the
CHC with design revie authority over additions.  

 

So, we are back to the drawing board.  We welcome your thoughts and examples
of adopted language specific to additions.

FYI, my not always accurate memory says the model template for a demolition
delay bylaw from MHC includes a definition of "demolition".  You can get a
copy of the template from Chris Skelly at MHC or also, I think, at the MHC
website.

 

That being said, we have such a definition in our draft demolition delay
bylaw that we're taking forward to the May Town Meeting.  The definition is:
"Any act of substantially pulling down, destroying, removing or razing a
structure, or any portion thereof, or commencing the work of destruction
with the intent of completing the same.  "Demolition" as used herein also
shall be deemed to include demolition by neglect or arson."

We have a situation in Medfield that is causing the Historical Commission
some heartache.  An applicant came before us with a demolition application
for a small ell in the rear of an iconic and historic building.  We approved
the application after some discussion and give and take.

Now we have a situation where the owner has, in addition to taking down the
ell, has basically stripped the exterior of the building down to the
sheeting.  He has also gutted the interior, due to structural problems, but
we have no oversight or control over that.

In discussions with the owner, he states that he will restore the exterior
to its original appearance (although he now states that he will use Hardie
Board rather than cedar).

The question we have is -- does this stripping of the exterior meet a
definition of 'demolition'?  The town's legal counsel says it does not.

I would be interested in hearing from all of you.
