If I read the first link that Jim supplied correctly only those parts of the house effected by the renovation need to meet code. Presumably since the windows aren't being removed they would not need to be updated. To be safe I would suggest talking to the local inspector before applying for the permit. It's been my experience that they are generally willing to help.
Another poster suggested that HERS maybe risky because it's done at the end and if a component such as insulation is done wrong they might fail. I would suggest that a competent builder and skilled inspector would catch these problems before it's too late. At least in a perfect world. It would at any rate the contractor's responsibility to meet the rating.
On a side note there are still windows being sold that don't meet the stretch code be careful.  Fortunately during a pre meeting for an addition I built the inspector pointed out in passing that she would not approve windows that were close but didn't adhere to the requirements.
