David,We had exactly this situation in our Pleasant St. Historic District a few years ago.  Basically, we just said no.  The developer, a long time exploiter of seemingly vacant lots threated us with his lawyer but backed down & sold the back house  to someone else, who developed it into two condo units, after making minor alterations which we approved.  I don't know of any decided cases on the issue, but perhaps Chris Skelly does.John Worden
