Michael, as I read your bylaw, it makes no requirement on an actual nomination from those organizations.  (See below)  If no nominations are received within 30 days, the Board of Selectmen may make appointments without a nomination.  This required nomination process is from MGL Chapter 40C-The Local Historic Districts Act.   Those nominating organizations may choose to not submit a nomination but the effort on the part of the Board of Selectmen to send a written request for a nomination is still a required process in MGL Chapter 40C and your local bylaw.

For the chapter of the American Institute of Architects, I believe central MA towns would still contact the Boston Society of Architects, as the local AIA chapter.

The Commission shall consist of five members who shall be appointed by the Board of Selectmen. The Commission shall include one or more residents of or owners of property in the District as shall file application for membership; one member from two nominees submitted by the Uxbridge Historic Society, or in the absence thereof, by the Society for the Preservation of New England Antiquities; one member from two nominees submitted by the chapter of the American Institute of Architects covering the Town of Uxbridge; and one member from two nominees submitted by the board of realtors covering the Town of Uxbridge. If within 30 days after submission of a written request by the Board of Selectmen for nominees to any of the organizations herein named, no nominations have been made, the Board of Selectmen may proceed to appoint members to the Commission without nominations by such organization.

Appointments were recently made to the Uxbridge Historic District Commission. The Uxbridge By-law merges parts of MGL 40C, Section 4 in a way that is not workable as as it requires nominations from the local board of realtors and American Institute of Architects local chapter. Neither exist!

My inclination is to go to Town Meeting and amend & simplify the appointments process without organizing a study committee (which section 4 seems to suggest).

Does anyone have any experience doing this?
