In the absence of a bylaw on teardowns, the only recourse would be to pressure the Board of Appeals to make preservation a condition of the 40B permit.  Given the nature of the waterfront market, pressure should be applied to the Board of Appeals to put strict language in for resale especially.  
Another avenue for attack requires playing outside of the preservationists' typical arena through some in-depth financial analysis.  Make sure the proforma isn't loaded with fees such that the allowable profit percentage can be increased and make sure the excess profit is determined by professional audit and that the entire development process is "open book."  We've observed that this kind of pressure can soften the developer to consider ways of accommodating preservation.
