[MassHistPres] Proposed Rule Changes National Register of Historic Places — NRD nomination veto

With apologies to anyone who will have received the recent posting from Preservation Mass to its mail list — that message makes clear something not included in the original message from NCSHPOs

 An N.R. historic district nomination can be blocked if only one property in the entire district, regardless of size, — for instance a Post office — is owned by the US Government and that agency objects to listing.

Also, in addition to submitting comments to the site listed below.  If you know a legislator — reach out to him or her.  I can tell you from personal experience, it can be effective in getting a Federal rule changed.

Several of the proposed rule changes go well beyond the intention of the NHPA.  The proposed rule would give federal agencies sole authority to identify or nominate historic properties on federal lands.  This would contradict current rules, under which State Historic Preservation Officers are required to weigh in on National Register nominations by federal agencies, and where SHPOs as well as communities can pursue nominations that include federal properties.

Presently, if the majority of private property owners object, a nomination cannot go forward.  But the proposed rule adds that a district cannot be listed if the owners of a majority of the land area object, even if the majority of owners support the nomination.
