The Commission already has jurisdiction over all the publicly-visible components of parking lots, doesn't it? Perhaps your purposes would be served if the HDC adopted a regulation exempting "improved impervious surfaces" of less than 1,000 s.f. from review.
Otherwise I think you're getting into zoning territory. Just the subject line of this email chain - "regulating parking" - implies the intent to regulate use, which is forbidden under Ch. 40C.

Thanks everyone for the comments.
To clarify my earlier email, the Commission would like to review 'parking areas', which would become a defined term and would also be included as part of the definition of a structure, similar to walkways and driveways. For instance, a parking area could be defined as an 'improved impervious surface of 1,000 sq. ft. or larger'. The Commission is not trying to regulate use but the parking area. I realize that this may be a stretch and am curious if any community has also looked into this topic.

All,
The Town's Historic District Commission is interested in regulating parking in the two local historic districts. The reason is that we have such a strong demand for housing from the off-campus college students that a 'typical' residential property also accommodates more vehicles than expected.
Are there examples from other Local Historic Districts were parking is subject to review? Thanks so much.
