[MassHistPres] 40 B conditions

Mendon has had experience with a 40B developer who was allowed by the
Massachusetts Historical Commission to raze an 1830 farmhouse deemed
eligible for NHR nomination. The eligibility included a barn and shop. In
order to demolish the house, there was a Memorandum of Agreement among MHC,
DEP and the developer to retain, reuse and integrate the c.1830 barn into
the development and restore and reuse the other building which is known as
the Cobbler's Shop. The barn was razed and the shop has been allowed to
deteriorate for eight years. The shop has been deeded to the town and the
Mendon HC is working with the developer, the local ZBA, MHC and DEP to
arrive at some sort of settlement. My advice would be to insist on a
substantial bond and to closely oversee the project.

All: The Tewksbury Historical Commission is confronting a short notice
hearing on an application to convert a significant
historic building into MGL 40 B rental units. The developer indicates that
he is on board for preservation of
historic/architectural features. Does anyone have any experience/knowledge
as to whether the Permit granting
authority can impose something like a 40B version of a preservation
restriction as a condition of it approval?
