However, be aware that MHC can’t intervene if there is no state or federal funding or licensing — and the state agency that does the actual licensing apparently takes the position that permitting a 40B is not granting a state license — go figure!
Sometimes MHC only gets a handle on mitigating a 40B's adverse impart if there is some other environmental trigger involving some other agency — such as a drainage issue. So, it’s important to look for such issues that can cause the “historic” box to be ticked on an ENF.
