There's another consideration in addition to the legal one, and that's
the extent to which the project funding will be used to further a public
good. This might be because it preserves an important viewscape in
town or because some form of public access to the property is
maintained. Requiring a public benefit not only helps prioritize the
use of CPA funds, but also helps when dealing with the inevitable
criticism that a single property owner is getting the benefit of tax
revenues.
