[MassHistPres] reconstruction question

Hi All,an interpretation question. In the matter of reconstruction, due to fire ,storm or natural disaster  MGL40C states as an exclusion from review, the following:
MGL 40C
In section 8 paragraph 8   
(8) The reconstruction, substantially similar in exterior design, of a building, structure or exterior architectural feature damaged or destroyed by fire, storm or other disaster, provided such reconstruction is begun within one year thereafter and carried forward with due diligence.

My question is who in fact determines if the reconstruction IS similar in exterior design?  Can it be assumed that the commission would look over proposed plans but does not need to fully review with a public hearing, if the proposed design is similar in exterior design  and does not need to issue a CA ?Thank you much for inputAlisa StruthersTownsend Historic District Commission
