Hi Meghan, Rather than a landmark bylaw, Wellesley should consider single
property local historic districts under MGL Chapter 40C. The law clearly
states that single property local historic districts are allowed.
"The buildings, structures or sites to be included in the proposed historic
district may consist of one or more parcels or lots of land, or one or more
buildings or structures on one or more parcels or lots of land."
The City of Somerville has several hundred MGL Chapter 40C single property
local historic districts scattered throughout the city. Woburn, West
Springfield and Lincoln also have single property local historic districts.
The process of establishing a single property local historic district is
basically the same as establishing a new local historic district. The
process involves the submittal of a preliminary study report to our office,
holding a public hearing at least 60 days later and a two thirds affirmative
vote by town meeting or city council. This process is detailed in our
Establishing Local Historic Districts guidebook.
If you have any questions, please feel free to contact me. Chris.

Subject: [MassHistPres] Landmark's Bylaw
Good Morning,
I am writing to inquire about good Landmark's Bylaws. Wellesley is trying to
get some funds through the Community Preservation Committee to study and
write a new Landmark's Bylaw. It would be great to know the following:
What communities have such a bylaw?
Is it online for review? If so, is there a link?
Was a consultant hired to write it?
How effective has it been?
I think if the CPC did not grant the money for a consultant, we would move
forward with drafting our own study and bylaw provisions. We feel it is
truly necessary at this time, so any information would be greatly
appreciated.
