Hello Betty,
I would check to see what your Historic District Ordinance says and check with your Law Department on the process to follow.
Newton's ordinance states that no building permits shall be issued for a property that is determined to be in violation. Our process is that staff sends a violation letter, the violation is put on a meeting agenda and noticed, and at the meeting, the commission must vote to confirm the violation. If they do, then we can put a stop to any new building permits being issued until it's resolved. The commission can also request fines of up to $300 per violation per day.
I believe the building department can also issue fines if a Stop Work Order is violated or if the owner didn't get the necessary permits.

A property owner is not observing a stop work order issued by the building inspector. The owner did not apply for nor receive a certificate from the Historical Commission/Historic District Commission for the work involved.
Do any of you have experience to tell us what your Commission did in these circumstances?
